President Biden has nominated a third member to the Merit Systems Protection Board (MSPB). The three-member Board is typically made up of two members from the nominating President’s party and one member from a different party. President Biden previously nominated the two Democrat members, and his third nomination of Tristan Leavitt as the Republican nominee rounds out a full slate of potential new members to the MSPB.
If confirmed, Mr. Leavitt would be new to the official role as a Member of the MSPB, but he is no stranger to the inner-workings of the Board, including during this unprecedented period wherein the Board has lacked quorum. Mr. Leavitt has served as the acting chief executive and administrative officer for the MSPB since March 1, 2019.
Now that a full three-person slate of Members has been nominated, it is more likely that the Senate will begin the confirmation process sooner rather than later.
